Texas Department of Licensing and Regulation

(TDLR) inspectors often enter a salon or shop to

perform an inspection and are greeted by a new

establishment owner. But, many times the es-

tablishment license is still in the former owner’s

name or in the name of an obsolete business

partnership or corporation.

Cosmetologists Rule 83.29 and Barber 82.29

states when an establishment changes owner-

ship, the new owner MUST apply for a new estab-

lishment license within 30 days after the change

in ownership. A change in ownership can include:

(1) a cosmetology or barber business owned by

one person is sold to another person who begins

operating it, (2) a business is owned by a partner-

ship and the partnership is dissolved, (3) a corpo-

ration is the owner and the corporation is sold to

another person, or (4) the owner of the business

becomes legally incompetent or dies.

TDLR inspectors find when an owner of a salon

or shop dies a family member will often step-in

and try to keep the business open and serving

clients. A family member can continue to run the

shop, but must apply for a new license within 30

days of the owner’s death. To download the form

Cosmetologists and barbers working in a salon

or shop that has transferred ownership but hasn’t

applied for a new license are putting themselves

in jeopardy to receive a violation under the rules.

Licensees may only work in a licensed facility; an

establishment operating under a former owner’s

license is the same is operating without a license

because the present facility has no license!
